Terms & Conditions relating to the Sale of Products to You by GUINNESS WORLD RECORDS:
The following Terms and Conditions govern the sale of products to you by GUINNESS WORLD RECORDS LIMITED (hereafter "us" or “we”) on guinnessworldrecords.com. Please read these conditions thoroughly before proceeding with a purchase from this site. By ordering goods from this site, you signify your agreement to be bound by the following Terms and Conditions.
1. THE CONTRACT BETWEEN US AND YOU
When you place an order to purchase goods from us, you will receive an e-mail from us confirming the receipt and details of your order. Your order represents an offer to purchase a product from us which is accepted by us when we send you an e-mail confirmation stating that we've despatched your goods; such acceptance will be complete at the time we send you the email. Any products on the same order which have not been confirmed in our email to you as having been despatched to you do not form part of that contract.
For contractual purposes, you consent to receive communications from us electronically and you agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing. This condition does not affect your statutory rights [see B below]
2. DELIVERY & DELIVERY RATES
Items sold by us on the guinnessworldrecords.com website are despatched from our premises in London, United Kingdom. Click here for information on Delivery and Delivery Rates within the UK and overseas [see A below]
3. RETURNS POLICY
If your item is defective or you have received an incorrect item, you can return it to us within a period of thirty (30) days of the date you received the item and we will ensure that you will either receive a full refund for the price you paid for the item or a replacement item of the same value.
If you live within the European Union you are also entitled to a statutory “cooling-off” period of seven (7) working days from the date of receipt. Details of this statutory right and an explanation of how to exercise it are provided by clicking here [see B below]
If you live outside of the European Union we can only accept the return of items if they are faulty. Please note that we reserve the right to send back items to you that have been returned to us after thirty (30) days unless they are faulty.

4. PRICING AND AVAILABILITY
All prices are listed in GBP. All displayed prices are valid until December 31, 2010. All goods are listed subject to their availability. As we process your order, we will inform you by e-mail if any goods you order turn out to be unavailable.

5. OWNERSHIP AND TITLE
All ownership, title and risk of loss and/or damage in the goods you have purchased shall pass to you at the point and time at which such goods leave our premises in London.
6. CUSTOMS
If your delivery address is outside the United Kingdom, the addressee will be the importer of record and must comply with all laws and regulations of the country into which the goods are delivered. The goods may be subject to import duties and taxes, which are levied once the goods reach the country of delivery. Any such additional charges levied for customs clearance must be borne by you. Please note that we have no control over these charges and cannot predict what they may be at any time in the future.
7. PRIVACY
We are committed to protecting your privacy. We will only use the information collected from you in a lawful manner and in accordance with the UK Data Protection Act 1998. The type of information we collect about you includes: your name, address, phone number and e-mail address. We will not pass on your details to any third parties. 8. CHILDREN
We do not sell products for purchase by children. If you are considered a minor in your jurisidiction (in the United Kingdom, this is below the age of 18), you may purchase goods from us only with the participation of a parent or guardian.
9. LOSSES
We will be responsible for any losses you suffer as a result of us breaching these conditions if the losses were reasonably foreseeable to both you and us when you submitted your order to us, or a contract for the sale of goods by us to you was formed. We will not be responsible for any business loss (including loss of profits, revenue, contracts, anticipated savings, data, goodwill or wasted expenditure) or any other indirect or consequential loss that was not reasonably foreseeable to both you and us when you submitted your order to us or when a contract for the sale of goods by us to you was formed. We do not limit in any way our liability by law for death or personal injury caused from our negligence or breach of duty.
10. EVENTS BEYOND OUR REASONABLE CONTROL
We will not be held responsible for any delay or failure to comply with our obligations under these conditions if the delay or failure arises from any cause which is beyond our reasonable control including but not limited to any statutory changes or rulings by any act or customs authority affecting the customs duty payable by you. This condition does not affect your statutory rights.
11. GOVERNING LAW AND JURISDICTION
Your relationship with us is governed by and construed in accordance with the laws of England and Wales. We and you agree to submit to the exclusive jurisdiction of the Courts of England and Wales.

13. AMENDMENTS TO TERMS & CONDITIONS
We reserve the right to make changes to our policies, and these Terms & Conditions at any time. You will be subject to the policies and Terms & Conditions in force at the time that you order goods from us, unless any change to those policies or these conditions is required to be made by law or government authority (in which case it will apply to orders previously placed by you). If any of these conditions is deemed invalid, void, or for any reason unenforceable, that condition will be deemed severable and will not affect the validity and enforceability of any remaining condition.
A) DELIVERY & DELIVERY RATES
DELIVERY RATES WITHIN THE UNITED KINGDOM
For deliveries to England, Scotland, Northern Ireland and Wales, your goods will be sent via First Class Royal Mail Signed For™. If you are ordering the reproduction of the first ‘GUINNESS BOOK OF WORLD RECORDS’, the combined weight of one (1) book plus postage and packaging is 1KG. Post and packaging for one book shall be charged at five (£5.00) GBP. If ordered within the same order, each book thereafter shall be an additional £3.25 GBP.
DELIVERY RATES WITHIN EUROPE
For deliveries within Europe, your goods will be sent by Airmail. If you are ordering the reproduction of the first ‘GUINNESS BOOK OF WORLD RECORDS’, the combined weight of one (1) book plus postage and packaging is 1KG. Post and packaging for one book shall be charged at seven pounds fifty pence (£7.50) GBP. If ordered within the same order, each book thereafter shall be an additional £6.29 GBP.
If you would like item(s) delivered by Royal Mail International Signed For™ please add an additional £3.70 GBP to the above cost.
DELIVERY RATES TO REST OF WORLD, INCLUDING NORTH AMERICA
For deliveries to non-UK/ non-Europe addresses, your goods will be sent by Airmail. If you are ordering the reproduction of the first ‘GUINNESS BOOK OF WORLD RECORDS’, the combined weight of one (1) book plus postage and packaging is 1KG. Post and packaging for one book shall be charged at thirteen pounds fifty pence (£13.50) GBP. If ordered within the same order, each book thereafter shall be an additional £12.26 GBP.
If you would like item(s) delivered by Royal Mail International Signed For™ please add an additional £3.70 GBP to the above cost.
Please remember that your order may also be subject to customs charges, over which we have no control, and the cost of which must be borne by you.
B) COOLING OFF PERIOD & STATUTORY RIGHTS
Customers in the European Union have a legal right to withdraw from the purchase of an item within seven (7) working days of the day after the date the item is received by you – this is known as the “cooling off period”. If you wish to exercise your cancellation right you must return the goods to us (in the same condition and quantity as they were in when you received them) within the cooling-off period.
Please securely package the item that you don’t want any more and send it to the following address: RETURNS, GUINNESS WORLD RECORDS LIMITED, Third Floor, 184-192 Drummond Street, London, NW1 3HP.
Please note that you will be responsible for the costs of returning the item to us unless we delivered the item to you in error, or if the item is inherently defective.
As soon as we receive notice of your cancellation of an order within the cooling off period, we will refund the purchase price and the original postage and packaging charge. C) RETURNING AN ITEM?
IF THE ITEM IS DEFECTIVE WITHIN 30 DAYS OF RECEIPT BY YOU
In the unlikely event that you have a faulty item, you have the right to return it to us within thirty (30) days of receipt by you. Please send faulty items to the following address: RETURNS, GUINNESS WORLD RECORDS LIMITED, Third Floor, 184-192 Drummond Street, London, NW1 3HP
IF THE ITEM BECOMES DEFECTIVE AFTER 30 DAYS OF RECEIPT
Depending on the circumstances and the nature of the item, we are not obliged to accept defective items after a period of thirty (30) days. Please note that we do not offer a returns policy on books after a thirty (30) day period has elapsed from the date of receipt by you.
IF YOU HAVE RECEIVED AN INCORRECT ITEM FROM US
As soon as possible after receipt by you of the incorrect item, please return the item to us at RETURNS, GUINNESS WORLD RECORDS LIMITED, Third Floor, 184-192 Drummond Street, London, NW1 3HP and we shall refund you the actual postage costs you incurred returning the item to us, and either offer you a full refund or replace the incorrect item with the correct item as soon as we can.
D) CREDIT & DEBIT CARDS
We accept most major credit and debit cards. If you are paying for your item(s) by a credit or debit card you will be asked to enter your card details as part of the ordering process, and you will find further instructions when you process your order. We will keep your details safe and secure in accordance with our Privacy Policy.
On the date of despatch you will receive an e-mail message from us confirming the date, contents and method of delivery.
